when someone under aged looks at pornography on the internet? the website or the kid? please tell me if this has been discussed

It depends. If you are talking about the United States, the website is most at fault for providing pornographic access to a minor. Most states consider this to be "Contributing to the Delinquency of a Minor", while a few have separate indecency laws that are even harsher.

The minor is at fault to a point...but minors are generally considered to be "less responsible" for such things because they are younger and "don't know any better." It varies on a state-by-state basis, but those are some general guidelines.

The porn site would have to show that it took reasonable precautions against it being seen by the minor. You will note that all X rated sites have warnings telling people that if they are under 18 to go away. (ie a legal disclaimer) Most porn sites will also register with Net Nanny to try to prevent minors from coming across the site accidentally. Finally many of the sites require an Adult Verification Service (AVS). However, if a minor gets a hold of a AVS name/password there is not much the site can do to stop it. If a kid wants to veiw porn, he or she will probably be able to do it (their parents might catch them by looking at the history file or such, but that would be after the fact).

Legally -- right now -- if you have ignored an age verification (a statement telling you that if you click in you are validating that you are over 18 or 21, and are aware of the laws in your area regarding porn), then a site is not liable, and the burden is on you for falsifying information, though it is not a crime, per se.

If, however, a site did not have an age warning, verrifcation system, or memberrship for explicit imagery, the burden is theirs.

well, i found scarleteen from a porno site's main page where they have the legal stuff. it said "if you are 18 click enter, if you are under 18 click here to go to scarleteen" and i went.

I came across Scarleteen in the same was as Panda so whoever thought it would be a good idea to put a link to Scarleteen on some kinky porn websites would be rewarded with a large pay check at an advertising agency!

I believe that in Britain, while websites must display "over 18" sign, there is no law to stop minors (including me) looking at them. Carol Volderman goes on TV every now and then shouting at an ISP manager about how the Internet is corrupting young people but I think the only time the law comes down on websites is when child pornography is involved. I can sympathise with that stance.

Would that that were so. Unfortunately, it was my idea, and it took a lot of work to start convincing adult sites that out of respect to youth, they should provide that link. Sadly, if someone is getting the big fat checks, it ain't me.

For general purposes -- NOT because I am endorsing those under 18 ignore legal warnings or falsify their age, because I don't think that's okay -- your browser chace can be cleared easily in your browsers preferences, typically listed under 'advanced" preferences.

your history is in internet explorer(the litle blue e in the bottom task bar) click on it and on the top menu you will see "history" click it and to your left you will see your history...highlight and delete if you must...

Thank you, I dont believe my parents would really mind too much about what I was looking at. Most of it is educational and they are fairly liberal people. Its just, I dont really want them knowing the sort of things I think about, at least not just yet.
